Terms & Conditions

Effective Date: July 13, 2025

Welcome to the Lunova Digital website. By accessing or using this site and any of our services, you agree to be bound by the following Terms and Conditions. Please read them carefully. These terms apply to all visitors, clients, and users of our website and services. If you do not agree with any part of these terms, you must not use our site or engage our services.

1. Overview

Lunova Digital ("we", "us", or "our") is a digital agency offering professional services in UI/UX design, web development, and digital marketing. The following terms govern your use of our website (www.lunovadigital.com) and any services provided directly or indirectly through our platform.

2. Service Engagement

All projects begin with a discovery process to understand the scope, timeline, and goals. Upon mutual agreement, a written proposal, scope document, or contract may be signed outlining the details, deliverables, timelines, and fees involved. The client agrees to provide all necessary information, feedback, content, and approvals required to complete the project in a timely manner.

We reserve the right to decline a project if we believe it does not align with our services or values.

3. Payment Terms

Payment terms are established in the proposal or agreement shared with the client. A project may require an upfront deposit before work begins, with remaining balances due upon completion or milestone delivery. All invoices must be paid in full within the time stated (typically 7–15 business days).

Late payments may result in project delays, suspension of work, or additional fees. Lunova Digital reserves the right to withhold final files or site access until full payment is received.

4. Intellectual Property

Unless otherwise agreed in writing, all designs, code, content, and deliverables created by Lunova Digital during the project remain our intellectual property until full payment is made. Upon full payment, the client receives full ownership and rights to the final deliverables intended for public use (e.g., website, branding, marketing assets).

We reserve the right to showcase completed projects in our portfolio or marketing materials unless otherwise agreed.

5. Client Responsibilities

To ensure a smooth and timely workflow, clients are expected to:

  • Provide accurate and complete information at the start of the project.

  • Deliver all required assets (content, images, access, etc.) promptly.

  • Respond to feedback requests within agreed timelines.

  • Review and approve project milestones as they are delivered.

Failure to meet these responsibilities may result in project delays, scope changes, or additional costs.

6. Revisions and Scope Changes

Each project includes a limited number of revisions as defined in the original agreement. Additional revisions or changes to the project scope, once work has started, may require a timeline extension and additional fees. We will always communicate these changes clearly before proceeding.

7. Cancellations and Refunds

If a project is canceled by the client after work has begun, any completed work up to that point will be billed accordingly. Deposits are generally non-refundable, as they secure time and resources dedicated to the project.

In the rare case that Lunova Digital is unable to complete a project due to unforeseen circumstances, a partial refund may be issued, based on the portion of work not completed.

8. Limitation of Liability

Lunova Digital shall not be held liable for any direct or indirect damages resulting from the use of our website, services, or digital products. This includes loss of business, profits, or data. We make no guarantees of specific outcomes or results unless expressly stated in a signed agreement.

Clients are responsible for backing up their own data and ensuring that all final deliverables are used in compliance with relevant laws.

9. Confidentiality

All information shared with us for the purpose of your project is kept strictly confidential. We will never share or use client data for any purpose outside the scope of the project, except with your written permission or where legally required.

10. Third-Party Tools and Services

We may use or integrate third-party platforms, plugins, or services (e.g., Wix, WordPress, Google Analytics, marketing platforms) as part of your project. We are not responsible for the policies, performance, or terms of those third parties, and we encourage you to review their terms of use as well.

11. Changes to These Terms

Lunova Digital may update these Terms and Conditions at any time without prior notice. Any changes will be posted on this page with the updated effective date. Continued use of our website or services after changes have been made constitutes your acceptance of those changes.

12. Governing Law

These terms are governed by and interpreted in accordance with the laws of the United States and the State of New York. Any disputes arising from these terms shall be resolved in the appropriate courts located within New York.
